นิติกรณ์เอกสาร

การทำนิติกรณ์ คือ การรับรองลายมือชื่อของผู้มีอำนาจในการลงนามในเอกสารราชการหรือหน่วยงานอื่น ๆ เพื่อให้เอกสารที่ออกโดยหน่วยงานในประเทศหนึ่งสามารถนำไปใช้และมีผลทางกฎหมายในอีกประเทศหนึ่งได้

กรณีมีความประสงค์ให้สถานกงสุลใหญ่ฯ รับรองเอกสารที่ออกโดยหน่วยงานจีนเพื่อใช้ในประเทศไทย เนื่องจากสถานกงสุลใหญ่ฯ ไม่มีอำนาจในการรับรองเอกสารโดยตรง ขอให้ท่านดำเนินการดังนี้:

๑) นำเอกสารที่จะรับรอง (ฉบับจริง) ไปรับรองการแปลเป็นภาษาอังกฤษที่โนตารีพับลิค (Notary Public/ 公证处) ในมณฑลเสฉวนหรือนครฉงชิ่ง

๒) นำเอกสารที่รับรองการแปลเป็นภาษาอังกฤษแล้วไปยื่นต่อที่สำนักงานการต่างประเทศ มณฑลเสฉวน หรือนครฉงชิ่ง  

๓) นำเอกสารตัวจริงที่ได้การรับรองจากสำนักงานการต่างประเทศมารับรองนิติกรณ์ (双认证) ที่สถานกงสุลใหญ่ ณ นครเฉิงตู โดยสแกนเอกสารที่รับรองทุกหน้าส่งมายังอีเมล [email protected] เพื่อให้เจ้าหน้าที่สถานกงสุลใหญ่ฯ ได้ทำการตรวจเอกสารทั้งหมด
และนัดหมายเวลาเข้ามาทำนิติกรณ์ที่สถานกงสุลใหญ่ฯ ในโอกาสแรก

กรณีมีความประสงค์ให้สถานกงสุลใหญ่ฯ รับรองเอกสารจากไทยเพื่อใช้ในประเทศจีน เนื่องจากสถานกงสุลใหญ่ฯ ไม่มีอำนาจในการรับรองเอกสารโดยตรง ขอให้ท่านดำเนินการดังนี้:

๑) นำเอกสารไปแปลแล้วรับรองนิติกรณ์ที่กองสัญชาติและนิติกรณ์ กรมการกงสุล (หรือจุดบริการที่กรมการกงสุลกำหนด) 

๒) นำเอกสารตัวจริงที่ได้การรับรองจากหน่วยงานข้างต้นมารับรองนิติกรณ์ (双认证) ที่สถานกงสุลใหญ่ ณ นครเฉิงตู

ระยะเวลา: การรับรองเอกสารใช้เวลาประมาณ ๕ วันทำการ (เช่น หากยื่นเอกสารในวันจันทร์จะสามารถรับเอกสารได้ในวันจันทร์ถัดไป) ยกเว้นในกรณีที่มีวันหยุดยาว ซึ่งจะมีการนัดหมายเป็นกรณีพิเศษ

ค่าธรรมเนียม: ๑๒๕ หยวน ต่อการนิติกรณ์ ๑ ครั้ง (ชำระผ่าน AliPay หรือบัตรเครดิตเท่านั้น)
ทั้งนี้ หากเป็นเอกสารที่แปลมาเป็นภาษาไทยจะมีค่าธรรมเนียมรวม ๒๕๐ หยวน เนื่องจากมีค่าบริการนิติกรณ์รับทราบคำแปลภาษาไทย ๑๒๕ หยวน และค่าบริการนิติกรณ์รับรองลายมือชื่อเจ้าหน้าที่ของสำนักงานการต่างประเทศ ๑๒๕ หยวน

หมายเหตุ

๑) กรณีการยื่นเอกสารแทนบุคคลอื่น ขอให้เตรียมหนังสือมอบอำนาจจากเจ้าของเอกสาร ยกเว้นกรณีการยื่นเอกสารของบุคคลในครอบครัว ได้แก่ บิดา มารดา บุตร สามี ภรรยา ไม่ต้องใช้หนังสือมอบอำนาจ แต่ขอให้มีเอกสารแสดงความสัมพันธ์ประกอบการยื่นรับรองเอกสาร

๒) กรุณามายื่นเอกสารตามวันและเวลาที่ได้นัดหมายไว้

Legalization of document

Legalization refers to the process of certifying the signature of the authorized person on an official or institutional document, so that the document issued in one country to be used and recognized as legally valid in another country.

For documents issued by Chinese authorities to be used in Thailand

Since the Royal Thai Consulate-General does not have the authority to certify Chinese documents directly, please proceed as follows:

1. Submit the original document to a Notary Public Office in Sichuan Province or Chongqing Municipality to have it translated into English and notarized.
2. Take the notarized document to the Foreign Affairs Office (FAO) of Sichuan Province or Chongqing Municipality for authentication.
3. Submit the authenticated original document to the Royal Thai Consulate-General in Chengdu for legalization

For documents issued in Thailand to be used in China

Since the Royal Thai Consulate-General does not have the authority to certify Thai documents directly, please proceed as follows:

1. Have the document translated, then legalized and at the Department of Consular Affairs (Legalization and Nationality Division) or designated service centers in Thailand.
2. Submit the original legalized document to the Royal Thai Consulate-General in Chengdu for legalization.

Processing Time: The legalization process takes approximately 5 working days (e.g., documents submitted on Monday can be collected on the following Monday, excluding weekends and holidays). Processing may be longer during public holidays.

Fee: 125 RMB per document/each legalization (by AliPay or credit card).

Please be informed that legalization of documents translated into Thai will cost a total fee of 250 RMB, which includes: 125 RMB for acknowledgment of the Thai translation; and 125 RMB for certification of the signature of the officer of the Foreign Affairs Office (FAO).

Remarks:

1. If submitting documents on behalf of another person, a power of attorney from the document owner is required. Immediate family members (father, mother, child, husband, or wife), are ​exempt​ from this requirement but must provide documents proving the relationship.
2. Please submit the documents on the date and time of the appointment confirmed by the Consulate-General.
